Terms & Conditions

These Terms govern your use of the JMV Boutique website and any purchases or rentals made through it. By placing an order or reserving a rental, you agree to these Terms. They are drafted in accordance with Estonian law, including the Law of Obligations Act (Võlaõigusseadus) and the Consumer Protection Act (Tarbijakaitseseadus).

1. Trader

JMV Boutique is operated from Tallinn, Estonia. For any questions about these Terms, please contact us at creatranssolutions@gmail.com.

2. Prices and Payment

All prices are shown in euros (EUR) and include VAT where applicable. Shipping fees and any applicable taxes are displayed at checkout. Payment is processed securely; your order is confirmed once payment has been received.

3. Orders and Delivery

We aim to dispatch in-stock items within 1–3 business days. Estimated delivery times are indicated at checkout and may vary depending on the destination and carrier. Risk of loss passes to you upon delivery.

4. Returns and Refunds

Consumers have a 14-day right of withdrawal for purchased items under EU Directive 2011/83/EU and Estonian law. Full details are available on our Returns page.

5. Rental Agreement

The following terms apply specifically to items reserved through our rental service. By confirming a rental reservation, the renter ("Renter") enters into a binding rental agreement with JMV Boutique ("Lessor") under the conditions below.

5.1 Rental Period

Each rental is for a fixed period selected at the time of booking. The item must be returned no later than the agreed end date. The Renter is responsible for the item from the moment of receipt until it is returned to and inspected by the Lessor.

5.2 Deposit

A refundable security deposit of 50 EUR is required for all rented items. The deposit is returned within 7 business days after the item is returned and inspected, provided no damage or loss has occurred.

5.3 Care and Use

The Renter must use the rented item only for its intended purpose, with reasonable care. The Renter must not wash, dry-clean, alter, repair, or dye the item — professional cleaning is included and handled by JMV Boutique upon return. The item may not be sublet, lent, or transferred to a third party.

5.4 Damage, Loss and Theft

Minor wear (small stains, light marks) consistent with normal use is included in the rental price. The Renter is liable for damage beyond normal wear, including but not limited to tears, burns, deep stains, missing parts, or alterations. In case of loss or theft, or if the item is returned in a condition that prevents further rental, the Renter shall compensate the Lessor up to the full retail replacement value of the item.

5.5 Late Return

Items returned after the agreed end date are subject to a late fee equal to the daily rental rate of the item for each day (or part of a day) of delay. After 7 days of non-return without communication, the item is considered lost and the full replacement value will be charged.

5.6 Cancellations

Rental reservations may be cancelled free of charge up to 7 days before the start date. Cancellations made between 7 and 2 days before the start date are refunded at 50%. Cancellations made less than 48 hours before the start date are non-refundable. The 14-day consumer right of withdrawal does not apply to rental services with a specific delivery date under § 53(4) of the Law of Obligations Act.

5.7 Title

All rented items remain at all times the sole property of JMV Boutique. The rental does not transfer ownership.

5.8 Fit and Suitability

The Renter is responsible for selecting the correct size. We recommend reviewing measurements and arranging a fitting in advance when possible. Refunds are not granted for fit-related issues once the rental period has begun.

6. Intellectual Property

All content on this website — including images, text, designs, and trademarks — is the property of JMV Boutique or its licensors and may not be reproduced without written permission.

7. Liability

To the extent permitted by Estonian law, JMV Boutique's liability for any indirect or consequential damages is excluded. Nothing in these Terms limits statutory consumer rights.

8. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Estonia. Disputes shall be resolved primarily through negotiation. If no agreement is reached, consumers may turn to the Consumer Disputes Committee (Tarbijavaidluste komisjon, https://komisjon.ee) or the EU Online Dispute Resolution platform (https://ec.europa.eu/odr). The competent court is Harju County Court (Harju Maakohus).

9. Changes to These Terms

We may update these Terms from time to time. The version in force at the time of your order or reservation applies to that transaction.
